Terms of Service

These Terms of Service (“Terms”) govern your use of khaiforcarvercounty.com (the “Site”), which is operated by the Khai Tran for Carver County Committee (the “Campaign,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

Campaign website

The Site provides information about Khai Tran’s campaign for Carver County Commissioner, District 5, and offers ways to receive updates, volunteer, request a yard sign, attend events, contact the Campaign, and contribute. The Site is campaign material. It is not operated by, sponsored by, or affiliated with Carver County or any government office or election authority.

Permitted use

You may use the Site for lawful, personal, and informational purposes. You may not:

Interfere with the Site’s operation, security, or availability.

Attempt to gain unauthorized access to the Site, accounts, systems, or data.
Upload or transmit malware, harmful code, or unlawful material.
Use automated tools to scrape, harvest, or collect personal information without authorization.
Impersonate another person, provide materially false information, or use the Site to harass, threaten, defraud, or violate another person’s rights.

Information and user submissions

You are responsible for ensuring that information you submit is accurate and that you have the right to provide it. You retain ownership of content you submit. You authorize the Campaign to use submitted information and content as reasonably necessary to respond to you, fulfill your request, operate campaign activities, and comply with law. We will not publicly use your name, photo, testimonial, or story as an endorsement without permission, except when you intentionally submit it for public use.

Contributions

Online contributions are subject to applicable federal and Minnesota law and to Campaign acceptance. By making an individual contribution, you certify that:

You are a United States citizen or a lawfully admitted permanent resident.

The contribution is made from your own funds, not from funds provided by another person or entity, and no one will reimburse you.
You are not making the contribution from the general treasury funds of a corporation, limited liability company, or other prohibited source.
The contribution will not cause your aggregate contributions to the Campaign to exceed $600 during the 2026 election year.
The information you provide is accurate and complete.

Contributions are not charitable donations and are not tax deductible as charitable contributions. The Campaign may reject, limit, or refund a contribution when required by law or when it determines that accepting the contribution would be inappropriate. If you believe a contribution was made in error, contact the Campaign promptly. Refund requests are reviewed case by case and are not guaranteed except when required by law. Payment processing is also subject to the payment provider’s terms and privacy policy.

Campaign-finance law may require us to collect and report contributor information. Information included in filed reports may become public, subject to applicable law.

Email and text messages

If you sign up for email, you may unsubscribe using the link in any campaign email. If you separately consent to text messages, you agree that the Campaign or its service providers may send recurring campaign texts to the number you provide, including through automated technology when permitted by law. Consent is not a condition of making a contribution. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. You may revoke consent by any reasonable method.

Volunteering, events, and yard signs

Volunteer participation is voluntary and does not create an employment, agency, partnership, or compensation relationship. Volunteers and event participants are expected to follow campaign instructions, applicable law, property rules, and reasonable safety practices. If you request a yard sign, you represent that you own the property or have permission from the property owner or lawful occupant to place the sign. You authorize the Campaign to contact you about delivery, placement, maintenance, replacement, or retrieval of the sign.

Campaign content and intellectual property

Unless otherwise stated, the Site’s text, graphics, logos, photographs, videos, designs, and other content are owned by or licensed to the Campaign and are protected by applicable law. You may view, download, print, or share Site content for personal, noncommercial political discussion or support, provided you do not alter the content in a misleading way, remove required disclaimers or attribution, or imply an endorsement that does not exist. Other use requires permission.

Third-party links and services

The Site may contain links to third-party websites or services. We do not control and are not responsible for their content, availability, security, terms, or privacy practices. A link does not necessarily mean that the Campaign endorses the third party.

Accuracy and availability

We try to keep Site information accurate and current, but campaign schedules, events, endorsements, election information, positions, and other content may change. Verify official voting, registration, polling-place, and election information with the appropriate election authority. We may change, suspend, or discontinue any part of the Site at any time.

Disclaimer of warranties

To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, the Campaign, candidate, officers, volunteers, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Site. Nothing in these Terms excludes liability that cannot legally be excluded.

Changes and termination

We may update these Terms by posting a revised version and changing the “Last updated” date. Continued use of the Site after an update means you accept the revised Terms. We may restrict or terminate access to the Site when reasonably necessary to protect the Campaign, users, the Site, or others, or to address unlawful or prohibited conduct.

Governing law; severability

These Terms are governed by Minnesota law, without regard to conflict-of-law principles. Any dispute relating to the Site or these Terms must be brought in a court with jurisdiction in Carver County, Minnesota, unless applicable law requires otherwise. If any provision is found unenforceable, the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver of that provision.
